    My new employer does not do any type of sponsorship and I was going to go to the previous employer, but they are not doing very good now:(

    So if I understand you correctly, you filed your I-485 while you were working for the new employer, but got your old employer to give you the evl so it would appear as if you are still with the old employer?

    Already did that in previous reply, the new letter says the evaluation is done basing on the syllabus but Mr vallabhu did not actually take math course as per the syllabus.

    I have my certificate from 1992 which also mentioned Math as one of the subjects I don't how he can miss that.

    Extensions are not allowed. But.... you can always enter Canada before the final date and then come back to the USA to finish your tasks. I have heard that you have to apply for the Canadian equivalent of the GC once you get there, which gets mailed out few days later, so if you have some one there it would be helpful. Also must have a visa to return back to the US.

    Your H1B extension has no value till 09/24/10 when it becomes active.
    You can probably go to India to get H1B stamped on July but you have to present your current H1B approval as the petition required and ( check with your office lawyer on this ) you are most likely going to get H1B visa valid till 09/23/10 ( based on your current petition ) . I don't know what your POE in US is , but I've heard/read anecdotes where the CBP officer at POE plays 'too much on top of his things' and tells people that their entry date is very close to their visa expiration date , that's when you bring out your extension approval. Once again , please check with your lawyer on possible issues to look out for, but this can be done.

    You can work legally in US with an expired visa and a legitimate H1B extension approval notice.

    I have personally seen few indian-nationals with US-GCs telecommuting on short-term (arround 30 days) while on vacation in india paid only in usa payroll and paying only USA taxes. The same may be applicable for AOS/AP/EAD.

    I think.
    short term (arround 30 days) - may be ok.
    vacation or telecommuting for longer duration (not sure about max # of days) is considered as abandoning AOS.

    I fully agree with mcq except for duration part.

    Here's how I see it.

    If you are employed by a US company and are on the US payroll of that company, and they are paying your salary into your US bank account, then I would say, that even though you may be working remotely in an Indian office of that US company - then yes, you need the EAD.

    Why - you might ask. Very simply, if you are on the US payroll you need to have an I-9 on file with the company. You can only file an I-9 if you have the legal right to work in the US for that company (EAD / GC / Citizen / H1B etc).

    so what it all boils down to is, no matter where you are working in the world for the company, if you are on the US payroll, you need an I-9, to file the I-9 you need a legal right to work, and that for you means the EAD.

    one other thing. I believe that you also need to be in the US to file for and receive the AP & EAD.

    I suggested the same when i met with the congressmen. There should be a MAXIMUM processing limit, it is unfair to suck our blood till eternity. They understand but cannot do anything without a consensus.

    Set a time frame and give a result accepted or denied or something. We can plan our lives accordinly even animals slaughtered according to a schedule.:mad:

    With the way things are going, it might soon make more sense to be illegal anyway :D
    Maybe our message needs to be

    CONSIDER LEGALS BEFORE ILLEGALS

    or

    GUARANTEE MAXIMUM TIME FOR GC PROCESSING
    aka if your GC is not processed in 1 year (or some known reasonable length of time) from getting your 485, they should just automatically approve

    The meeting was very well organized. Q&A session with Attorney Prashanti Reddy was very useful. Here are my suggestions:
    a) We can have these conferences every two months or whenever core thinks so.
    b) I think we should stick to immigration.
    c) Earlier 'Invite a friend/Add a member' campaigns were very successful as compared to flyer/poster campaign.

    Thanks for coming with your wife - this is the third meet and you both came for all the meets.

    Excellent input - we must do more of these. We are expanding now and getting support so I think we are in a position to do more stuff.

    Flyers and posters also play a crucial role as a first step to a lot of people.

    Well, you don't really have a choice now, do you? If she stays on in the US, she will extend her invalid status period. She cannot apply for a COS to H4 in the US because she doesn't have paystubs. Her only option is to go to India and get an H4 stamped and pronto. As to denial, it's all in the visa officer's hands.

    I have a old EB3 PD Sept 2003 with Company A , and a new EB2 and I140 approved from Company B.
    Can I ask my old company to file for I140 so that I may use the Old PD.

    How can I bear the expenses of the USCIS and attorney's fees, given I am not working at company A.

    Any clues would help.

    I guess the old labor will be invalid by now as it has been already been over 45 after approval.
    Ask a lawyer, because due to this labor substitution rule now you might have a problem. (" A GOOD LAWYER IS A SOLUTION HERE")

    Do what your company A is asking. I don't think that company A would file it for free.

    Give it out of your pocket, that is how you bear it, work at a gas station, 7 eleven if you have to make more money to give him

    someone please explain me how complete agreement works. I am working for the client through the main vendor who has a noncompete agreement with my employer (This is signed by my employer, not me). Now I am planning to leave my employer but the client is interested keeping me in the project through another vendor. Can someone explain me if it is possible?

    Since the Noncompete is between my employer and the vendor, how am I responsible since I didn't sign anything? Don't laugh, may be I am ignorant

    This is exactly what I did in the past and my desi employer could not do anything because I never signed anywhere, it was between him and the vendor.

    This is a client. My company gave a letter from immigration department saying EAD is a valid document to work. But their security team is just adamant saying they need valid visa & I94. So What helps me is some thing that says EAD is valid for legal employment or it is not legal to descriminate based on the status.

    I even have valid drivers licence etc. still they don't see it as valid.

    I 9 form does have i 766 as valid entry.
