Search immigration.com ("i-140 denied, urgent help please"). I went thru this, attorney was so-so, not experienced in handling cases like this as he is a small firm. So I went to one of the BIG firms and got it MTR'd and cleared in 3 weeks. I spent 3K, but never thought about it before or after.
While you work on backup options, dont just let go the current status that you got in 4-6 yrs.
The new attorney could easily make up for the pay.

So I assume your PD need NOT be current to get FP notice?
Correct - Assuming that your PD was current when you filled AOS, of course. If PD then retrogresses, I'm fairly certain you will still get the FP notice.
As I understand it, your AOS application continues all the way up until final approval - at this point if your PD is still retrogressed it goes to a "approved pending visa number availability" state. They do not put it on hold just because your PD retrogresses.

i was there in that situation. it was scary.
1. firstentry to usa i got i-94 until: nov 2002
2. extention i-797: nov 2002 to nov 2005. i sent for visastamping in usa june 2003 but mistakenly they gave visa until nov 2004. i went to india and came back to usa on mar 2004. at POE officer gave me I-94 until nov 2004 though my i-797 till nov 2005. i told to my company about my i-94 is expiring 1 year before than my i-797. they have half knowledge and they say it is fine since i have i-797 until nov 2005. i also felt that is reasonable and take it easy.
one fine day(april 2005) i was going through forum then i realised the most recent I-94 is valid than any other document but by the time i realised it, my I-94 expired on nov 2004. i called Murthy she said i am out status because my i-94 expired though my I-797 valid until nov 2005.
she suggested me to go to nearest POE and tell them they gave you wrong expire date and show them I-797.
I went to Minneapolis airport spoke to CBP officer he checked my i-797 and corrected my i I-94 to NOv 2005.
after that i got 2 more I-797s.
i suggest you to go nearest internation airport and contact CBP officer. tell them that they gave you wrong i-94 expire date and show new i-797

This is something that's doable without legislation. It would be done for employment based visas.

You are incorrect about out of status when person loses job on EAD.
As long as I-485 is pending, person is in valid status. Infact, one may chose do nothing while I-485 is pending as long as he has valid job offer that starts after I-485 approval.

Yes, a new passport ( from one of the US embassies in India). I don't think it is a new PIO card, but the new passport number will be 'annotated' in the Passport ( Indian embassies in US charge $20 for that ).

We quoted our personal life experience and the hindrances we encounter in our career growth.
I have to say the points were observered with a positive note. and the staff said that these will be conveyed to the Senator.
He also suggested, to contact the media, which we are doing and also told,
he was also aware of immigration voice and its good doings.
He also told the Senator voted in favour of CIR 2006.
He suggested having a direct meeting with Senator would definetly help, as it would have a better impact, but he said that it would be easy to get an appointment of the Senator in DC. At this point, we have requested the immigration voice DC members whether they can have an meeting with the Senator and we can arrange the same with this staff member.
He also requested, if any of our member are meeting with the same Senator office staff in different location(Detroit, Grand Rapids,Escabana etc), please refer this staff name for continuity reasons.

I will be sending a Thank you letter soon to this Staff.
We are waiting on Appointment from the following office as we have already faxed the request for appointments, after our initial telephonic request.

No, there is old Child Protection Act and it protects from aging out while I-140 is in process. So child age is determined as age on time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS.

My situation is as follows - My I-140 is approved and judging by the current situation my child will be above 21years (currently on H4) when visa becomes available.
My questions are - Will I be able to extend my child's H4 beyond his 21 years, assuming I continue on H1? And will I be able to adjust my child's status when visa becomes available?

there are few famous talk show hosts in KABC radio (Southern california), atleast 5 of them, who have larger listeners and they have devoted one hour everyday regd immigration issues (until they kill this CIR bill because they dont like amnesty issue), they do usually their programs from morning 8am and 5pm-11pm, so I request IV core team to contact their producers using their 1-800 numbers and explain the other side of story i.e. documented workers and how they suffer and what relief this bill can provide us.
