Congrats on getting your green card. Your post and attitude is the exact reason why DOL has made it almost impossible to get EB2 certification especially in the software field and why people despice consultants like you and your desi employer.
You said in your post "Appiled for EB3 labor in jan 2004, even though i am qualified for EB2" dear sir its not your qualification that determines whether you get to file in eb2 or not but it is what the job requirements are that determine whether it is eb2 or eb3.
Another line from your post "After realizing that the dates will never become current for EB3, my desi employer files for EB2 labor" this and the previous line clearly show that you and your desi employer have no respect for the law. It is because of blatant abuse like this that DOL is cracking down on eb2 filings. Now thanks to people like you and your desi employer who have abused the law now even eb2 india might never become current because tons of people have already ported and spillover to eb2 is not happenning anymore like previous years. People have realized even eb2 india is never going to move beyond 2003 so "consultants" like you and desi companies have moved on to abusing eb1. Seems like you are proud of your achievement just like the L1 folks from desi companies who brag about getting green card in less than an year by abusing L1.
To all the people who think they can pull a trick like mr salawrene by filing in eb2 again hard luck there are 120000 485 applications from India with USCIS with eb3 and eb2 having about 60000 each, because of abuse in Eb1 no more spillover of visa numbers to eb2 india wil occur so eb2 india will not move forward, on top of it dol is cracking down on eb2 filings. eb2 India might start moving backward to 2003 or 2002 and will remain stagnant like eb3 because no visa spillover is happenning.
because of desi consultants and desi employers abusing the system the whole EB community is suffering, high time we respected the law and stop this practise. for speaking the bitter reality if eb2 and eb1 abusers, consultants, desi employers want to give me a red go ahead and do it, but ask yourself have I said anything which is incorrect
I recived my I485 approval on May 30th after 10 years coming into this country.
I just want to mention my GC journey here, hopefully this will help atleast some of the members in making decisions in their process. Appiled for EB3 labor in jan 2004, even though i am qualified for EB2. Applied for I140 after the EB3 labor approval and received I140 approval. After realizing that the dates will never become current for EB3, my desi employer files for EB2 labor. Applied for I485 based on EB3 labor during the July Fiasco from the desi employer. After 180 days, took the permanent job with the client with base salary of almost 100% increase ( with bonus it might be around 150% ) and with manegerial duties. Mean while my EB2 labor from desi employer gets approved, so my desi employer files I140 for EB2 labor that gets approved with old priority date of Jan 2004 and I485 becomes current. Recevied RFE on my I485 for Employment Verification Letter. I took the EVL from both the current employer and the desi employer ( for future employment ) and written an affidavit saying that, i have the intent to join the desi employer once i recive my GC because he is such great employer, to keep the validity of I140 based on EB2 from desi employer. After one month of my RFE responce, i received my 485 Approval.
So You can always take promotions with more responsibilities using AC21, as long as you are in the same occupation, % of increase in salary doesn't matter. I have clearly mentioned my salary number in the EVL that shows huge difference.
My EVL clearly mentions that my current job duties includes more responsibilities and manegerial duties.
I read one big court case document involving 485 process by Rajesh khanna that the main important thing that USCIS looks for during 485 approval is inadmissability means no status issues. So as long as you are in the same occupation, you should be fine.
I had problems with my H1 and had to work around 150 days without H1B Approval after my I94 expiration, this was taken care of by 245K because of my travel to india with another H1.

So I assume your PD need NOT be current to get FP notice?
As posted earlier in this thread "MOST" people will get FP notices. Sometimes minors do not
(from I485 instruction form)
5. Biometric services.
If you are between the ages of 14 and 79, you must be fingerprinted as part of the USCIS biometric services requirement. After you have filed this application, USCIS will notify you in writing of the time and location where you must go to be fingerprinted. If necessary, may also take your photograph and signature. Failure to appear to be fingerprinted or for other biometric services may result in a denial of your application.

better ask a lawyer if its okay to take 2nd job on EAD but file for AC21 after Feb 08.
good luck
Gurus,
Here is my situation:
I-140 approved - PD: May '06
I-485 filed - July 30 '07 (India)
EAD cards - Received
APs - Received
Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
good luck

It appears you created this ID just today only to post this message.
Sounds fishy.
That is absolutely correct.
(I deleted the post on this thread. The poster shamelessly posted the company URL and info on his post to promote the consulting company.). We have immediately banned this user and have been deleting the same in the past too and banning this user.
This ID was created and the other ID for which this person was complaining was posting to promote his website and company on IV. The company is another consulting company trying to get employees from this site by luring them for greencard sponsorship. Now when IV deletes such posts, they start hating IV.
There have been several instances where other immigration site owners and health insurance agents for US visitors have created IDs on our site and posted information to promote their insurance or site. We will continue to delete them. This effort is not about making money like they do from the for profit site and company, but we use our contributions and money to help the lobbying effort. We will disallow anyone using this site to promote their business. We have seen what they have written against IV on other sites and this site and it proves that they do not care about this cause and just want to make money off members of this site. If some business or website, truly cares about this cause, they need to show it by posting IV banner ad on their website and/or contributing to this cause. And yes, we will definitely acknowledge their contributions on this site publicly. But we will not allow any business interest taking advantage of IV for their own promotion or financial interests.
There have been members who post insulting messages on the site and get banned. Once they get banned, they go to other sites and post negative messages against IV. IV has refrained from exposing them or countering them. We have better things to do and do not have time for their nonsense. However this thread should now tell our members how difficult it is to moderate our forums so that it does not go out of control and how we take decisions to ban members. We do not like to ban anyone. But only ban when it crosses the line.
We are not scared of any threats. Infact we have received threats from all kinds of people. As long as we do what is right and in the interest of our members we are certain we will win this struggle for which IV was created.
Sounds fishy.

My point was that it doesn't matter. It represents $1000/ per person, hardly enough to make a dent in poverty. We need sensible labor laws, a pro-business attitude, and that money will return to India.
Dude, I am sure a lot of that money in these accounts belongs to the same "Railbay Meeneester' you are talking about..

I am going to India for couple months and plans to return back on AP.I am planning to get my passport Renewal in India. Is it OK to Renew in India as it shows my India address.
Thanks In advance
I think its easier to get the PP renewal done in US as it can be done via mail.
But i think its equally easy to get it done in India. I got my passport renewed within a week in India just last month. There is a 'Tatkal Service' for passport and you can apply under that and get your passport renewed very quickly.
One thing though, if you change your address on Passport, then it may go for police verification, but if nothing chnages on ur passport, you can get it back quickly in using Tatkal...hopefully within 1 week like i did.

What happens to an employee at any company who has done something positive but has been caught abusing his colleagues a few times. He gets warned by HR first and then gets fired right.
We have lot of things to focus on to get relief for our community and there is no reason to tolerate this behaviour towards fellow members.
what abt all the positive remakes given..??

Thanks for all the info,
For AC21, I have read you don't need approve I-140, only approvable is good enough, new employer no need file new LC, no need ability to pay just have to be the same titile and similar pay. But I still not clear about self-employ.
Last question,
If I were to go with I-140 premium, and get approve let says October 15.
Is it going to do any good because 485 is even worse, right now is processing only Dec 2, 2005 and move slower than turtle. That's why I need to know somebody who get 485 approve from Nebraska to say something here. But I know basically people who already got 485 approved will never come back to spend time on this forum. But if you know friends or anybody got 485 approved please write something like Priority date and 485 receipt date.
Thanks again
As all the I-140's from CA and VT were transferred to NSC in April so it is slow. I guess they are currently working on cases filed in the month of April. If your I-140 is not approved by December then you might want to consider converting it into Premium Processing so that you can avail the benefits of AC21 once your I-485 is pending for more than 180 days.

News Clips won't help much. Better to get some documents from your Company that shows it really is on the downside like financial statements. However, make sure you also have a proof that when they applied for I-140 and you applied for GC, the company is still in good financial status; that is was only later that the company suffered losses.
92 days lapsed after submitting your GC application and you were approved. Do you have anough evidence to say that in June, the Company is doing alright but not now, September? that in June, your position is still available but not anymore in September? that the company did not hire any replacement for you?

It seems like except for one or two people here, individuals who have applied directly at TSC on 2nd July are getting their checks cashed/receipts this week.
It would be helpful to know if they are done with the transfer of 2nd July cases from NSC to TSC; if so, when and based on that, we can make some educated estimates.
Do you mean they would work on transfer cases first? My undrestanding is, it is based on the date received!

Hello,
I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).
https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC
12/15/2007 Status - 04/24/2007
01/15/2008 - 07/19/2007
06/15/2008 - 07/28/2007
Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).
