I believe Indians want to enjoy life too much after coming to US, the only way to succeed is to work hard and with sincerity . Based on the observation i see very few Indians fully committing themselves to work. not sure why :confused:

I am on the same board. I am also planning the samething.
1) After 11 weeks that is next week Friday call the customer service and raise a Service Request
2) Within 2 wks no response, on 90th day I will walk into the local office (SFO) and ask for interim EAD.
3) If Still create the issues, packe the bags and go back to home country. It is really bad,
getting frustrating for everything no regulare process and always waiting.
So I give up, I applied on april 1st and still waiting no updates:mad:
Agreed it's frustating, but I wouldn't give up so easily. i would continue working if they don't issue an interim EAD, if that becomes an issue later on (very unlikely that USCIS will figure out you worked during the EAD gap, do you believe they are that efficient?). The worst that could happen is 485 denial. at that time you can explain (to the court if necessary) that it was the USCIS who delayed processing on the case causing the gap in EAD's. BTW, upto 180 days of out of status stay, work without EAD etc is forgiven.

God bless everyone still in this situation. My son turns 21 in October and we too were faced with this threat. Thankfully we got our I-485 submitted in June and he even received a letter from USCIS directly to him confirming he is now locked in under CSPA protections (which we already knew, but was very nice anyway).
Our attorney had pointed to the potential in the DREAM Act proposals that keep resurfacing . Although primarily drafted to assist illegal children brough here by their parents, the provisions would also apply to children brought here in H4 who aged out. All the other conditions would have to apply, but we had intended to convert our son this fall to F1 and then hope that Dream Act would pass sometime in the next 2 years to save him before he turned 25.
Another angle for those of you trying to seek protection to explore with legislators as there is very broad support for DREAM but it keeps getting caught up in comprehensive reform agenda.
Good luck to all of you still trapped in this dilema, I share your pain and sympathize with the stress this places on you and more improtantly on your kids.

I applied for H1B and Change of Status in April 2007 and got approval for the same in August 2007.
I have to go to India so, I want to know Can I Travel outside US and re-enter on H4 visa (which is valid till 2009) before October 1st?(Before H1 becomes effective)
I am aware of the fact that you can not travel outside US while your application is pending. But in my case I have the approval. So is it possible?

You can come back to US on H4, but you may have to apply for change of status from h4 to h1 again, to be able to work in US.

Second factor what we need to look is Most of EB3 Mid 2002 to Mid 2005 are still in the system. Third factor what we need to understand is that EB3 filing is always more than double of EB2. Fourth fact is that USCIS has to see "FIFO" is followed or not. So end effect would be we will see EB3 India progressing from this December till April 2008 bulletins reasonably. EB2 will be put on hold . End result in summary would be both EB2 and Eb3 will be brought to Middle of 2005 by next June bulletin. Once that happens Eb2-I will moving faster with comparision to EB3-I.

The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.

Anyone received payment processing errors in the last couple of days on the E-File website? For some reason, while trying to complete payment for my AP e-file, when I try to use the credit card option, I keep getting an error that the e-filing payment processing server is unable to process payments at this time. I have been trying every hour for the last 2 days...and the stupid USCIS Customer Service number has no options to report this error...

The letter is very interesting not just because it puts a heck of a lot of pressure on DHS right now, but also because Lofgren's folks imply from the questions that USCIS was short circuiting established security clearance procedures to "pre-request" visa numbers from DOS. If it turns out full security clearances were not carried out, USCIS will either need to say that they had the legal justification (which would be a public relations disaster for the agency) or that they intended to complete the checks after the fact (which would be a direct violation of their own regulations). The only way to avoid answering the questions and to make this go away would be to eat crow and start working the case July cases.

I agree with you that we are divided in to 'n' number of groups and this is the major weakness of EB Community.
I do not feel it is correct when some one from EB2 says EB2 person is > EB3 and hence eligibile for quicker visa. The person who sits next to me got GC in July 2007. His PD was 2001 May and EB3. But he was doing the same role that I am doing. He changed his job using AC21 but could not do anything to change his EB categort at that time. Luckily he got GC otherwise he would have been in the first group that you have mentioned and suffering for years and years.
For many people GC is under EB3 due to various reason like employer and lawyer screwup. I can understand the frustration of people waiting since 2001. Same time everyone wants to get faster. So EB2 hates EB1 and EB3 hates EB2 and thats how life goes. We need to hate and love some to keep life interesting. :)
Its a classical case of too many people and very few visa#. Every one has a valid point

- Take 10 Minutes *NOW* to call these numbers to leave messages. If you are married, split these between husband and wife.
- If you call *NOW*, you just need to leave a Voicemail.
- Call at least 1 other friend and request him/her to call with these messages.
- Use your Yahoo! or Hotmail address book and send the messages to your contacts
- If you are on LinkedIn, send this message to your contacts.
- If you are on Orkut, 'scrap' everyone
This is key. Dont put this off.
No one will help you. You've got to help yourself.
This is one problem that cannot be 'outsourced'.
It is easy to say .... "well others are calling. I know I should call but ...(fill in your favorite excuse)"!!
15 minutes will potentially save you months of continued agony!

Just follow it. Please. Dont put this off. Dont expect 'someone else will do it'. Every call counts.

The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I called local office of the local congressman. The lady listened to me attentively and then advised me to call Washington office. She said the staff over there would be able to tell me how the congressman would vote on these bills.
I called Washington office also but there the operator said the person who looks into these matters is not at desk and advised me to leave a voice mail. I have left a detailed voice mail with my contact info.
I have to call 3 more congressmen from CHC and I will finish that in a short while.

Thank you for the info...My PD is 03/25/2005...A lot of people filed for their RIR or regular LC in the 2nd quarter of 2005 (jan-march) trying to get ahead of new PERM, which was supposed to have greater chance for an audit. Last day of old LC was 03/28/2005 and thus the hike of PD's that quarter...the following quarter you didn't see many LC approvals until lawyers and applicants were confident enough that the PERM system in fact was working as expected to start filinf for new appls, and thus the fewer approvals
It's hard to get a good idea when so few people participate in the poll so I took the data available on and ran a few numbers.

You'll have to zoom in a little to view the labels more clearly. The data is sampled quarterly on the chart.

It's hard to get a good idea when so few people participate in the poll so I took the data available on and ran a few numbers.

First, I am not promising to solve anything. I am just saying that I will bring up the issues when I have my meeting. If this thread is a distraction, then feel free to ignore it.
Second, those who have participated in this forum over the past year know about the issues I was working on.
Third, the forum moderators have my contact information and I have corresponded directly with them (Aman Kapoor). If you don't believe I am who I say I am, feel free to contact the mods.
I am not sure what the point is about "innocent Indians." Does it really matter if I am Canadian? Is this forum restricted to South Asians?
