Why should a drivers license be used as an ID ?
Even if it is an ID, it should NOT be linked to immigration status.
An ID says this photo and details are of the person holding the ID. It is meant to "identify" a person NOT for checking the immigration status.
If someone needs to check the immigration status, they should ask for immigration documents rather than a general purpose id.

I disagree based on the following:
note the "and" between (a) and (b) and note point (a) which states that a pending 485 is necessary for an alien to change jobs

You can port your PD based on your approved 140 even if your 485 has not been filed. I think someone had posted a FAQ from Rajeev Khanna's site which specifically said its allowed. Also, the same is available on Murthy's site too. And Finally, I've talked to three lawyers in the last one year and each one of them agreed that this can be done.

Get your degrees evaluated by the certified evluators and add your experience to be qualified or you can go for EB 3 but your priority date will remain the same. A friend of mine was in the same boat, but had 3 years commerce college and 2 years MBA from UK and was in his 9th year of H1, I 140 was denied. He appealed and REAPPLIED I 140 with all the evaluations, he got approval in less than a month but EB3 with the same old priority date.

Anyone can throw light into this one. Can we track APs now for NSC.
NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..
It will help lot of us who want to make some travel plans.. [some like us are eagerly waiting for past 4 yrs!!!]

I don't think anyone will be able to predict when someone will get AP approved. USCIS has mentioned that they are concentrating on EAD more than anything else (read AP). Also, unlike TSC, NSC only issued receipts so I suppose they are issuing EAD's now. AP seems far away. Even TSC is behind in processing AP.

My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

Mr. Vayalar Ravi , Minister of Overseas Indian Affairs,is coming to USA on June 27,2006. He is coming to Washington DC on July 4 to meet Indian Ambassador and Indian community. We should try to meet him personally and explain the problems we are facing. He can talk to US counterparts and do something for us.
Let us organize an event to meet him on July 4. Since It is a holiday, lot of people can meet him and chat with him.

I have a similar question. I have I-94 till Jan 2008 as my H1B visa is valid till Jan 2008. If I file an H1B extension in Dec, is that okay ? I know, approval would not come before Jan 08.I beleive as long as u dont hear something from USCIS u are still in status provided u filed before the expiry of ur I94.I also think they do send a new i94.

Truth always hurts. It is not too much talking when I say that people can't afford to contribute 20 bucks to IV. Out of roughly 9000 members, only 200 contributed in the last contribution drive and now you should be able to do the math yourself. That is the fact and it's very troubling that 98% of the members chose to contribute nothing.
If you expect 200 people to find relief for 1 million so called high skilled immigrants present in United States, may be you need to wake up and do some reality check. Just checking IV 50 times a day for an update will not bring any relief, if that's what you are counting on. No wonder we are yet to see any relief whatsoever.

So, since I'm all bitter and alienated , why did I actually contribute?
Every time I get annoyed or offended by someone's insensitive or cultural narrow mindedness, I try to ignore it and remind myself that that single person does not represent the values of the core group and this organization as a whole. It gets challenging.

Hi All,
I just joined this site today and wanted to get some input on the following situation:
My current situation is:
Working for a company ABC
completed 6 years on H1 and currently in the 7th year extension
Green card in process for more than a year - Eb3 with PD Jun 2002, I-140 approved
Can extend H1B again in about 6 months, for a 3 year extension
The question I have is , if one has a valid extended H1B for the 7th year and beyond, what happens if one were to lose their job during the extended H1B period, without getting their GC?
1) Can they continue to stay till the end of the extended H1B period by applying for a job with another company?
2) Or should they leave the USA as the first 6 years have been completed without getting a GC, and the extended H1B period would become invalid as soon as they lose the job with the company that processed the extended H1B?
Any input is appreciated. Thanks for your time.

"One additional reason for making sure that you have a valid EAD at all times is so that you can claim unemployment benefits in the event you lose your job. H nonimmigrants do not qualify for unemployment insurance. If you have an EAD, however, and can be referred out for job interviews, you do qualify for UI, even if you don't yet have your green card."
The above is quite interesting. I saw people who were laid off and had question about applying for UI if they are on EAD and this answer explains it really well.

I have changed jobs recently using EAD after over 180 days of filing 485 and 140 approval. Process is pretty simple if you do not wish to notify USCIS like me. Just fill out a I-9 form with EAD details with your new employer and give them a copy of the card (front and back) and with passport copies. Job title and description do not match completely with the LCA. Employer will help with employment verification letter with salary/title/responsibilties if and when a RFE is received.

I have sold a house in US while being physically in India. All you need to do is give a notarized affidavit to your Realtor and you don't need to be on the closing table. There is always a solution to worst case scenarios. Dude do some googling and you'll know what I am talking about.
You need to live in that house for at least 5 years to recoupe the commision/closing cost. Will you pay the loss if someone needs to sell the house suddenly due to immigration.

When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.
I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.
How many other people are as P-Oed as I am and is there a class action suit here?

also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?
