If we have a large number of people from the Southeast region, may be we can demonstrate in the front of the Atlanta PERM office. I think this may be crucial especially during this election time.

Hi,
My labor certification was filed in Dec. '06. Since its date of filing, the online case status was showing as "in process". However, on 07/20/07, last week, the status changed to "case denied".
1) What are the next steps?
2) Do I need to refile the labor certification. If yes, how soon can it be done?
3) Can it be filed for the same position or it needs to be filed for a different position?
4) Should I find a new employer to file for labor certification as my current employer could not get my labor certification approved or I should stick with this employer itself and file for a new labor certification?
Please help me out.
Thanks
Sorry to hear about your bad luck. It really depends on why the case was denied. Your best bet would be to talk to your attorney to find out why it was rejected. Depending on the reason, the attorney can file an appeal.

Susie,
You are only talking about children of illegals, E2, L1 visas and problems of British citizens since you are one. Your agenda is different than Immigration Voice. You should not promote your site on this site. You do not have Immigrationvoice link or banner on your site. It shows you are running your own organization without caring for IV and coming to this site to promote your site. IV agenda and your agendas are different.
I think the posts that promote other sites should be deleted.
Sorry your wrong about what I am trying to achieve and that is a pathway to a green card for all children and protection for any child aging out. I have tried to encourage IV to help or work on this issue and would be more than willing to assist them but it does seem their main focus is getting more H1B visa's and dealing with backlogs, but so many H1B children still age out and if their parent passes away whilst an AOS is pending the case dies with the parent, this is where a compassionate visa would come into play
The sad thing is , (or good if you view from a different angle) that there are not enough of us on this site that can take up the cause without the backing of IV

All,
I filed the online application for EAD renewal on May 3rd and required documents were sent to Phoenix drop box on May 6th. I paid the fees using a credit card. The EAD application was returned on May 15th. Reason a signature is not contained in the signature box of the application or petition. A signature in the "Signature of person preparing form, if other than above" block is not a valid signature for this purpose. Please sign and resubmit the application with the appropriate fees. How do you sign a online application? Did I do something wrong here? The EAD application which I received back from USICS is the applicant copy. Should I sign on the applicant copy or reprint a new completed EAD form. For the fees should I just submit the previous document showing fees paid through credit card.
Any response will be appreciated.
I believe you need to send the documents to NSC or TSC for efiled applications and not to drop box facilities. the drop box is for paper filed applications only.

US IMMIGRATION CLIENT ALERT
June 28, 2007
Employment-Based Immigrant Visa Numbers
May Become Unavailable Sooner Than Expected
EXECUTIVE SUMMARY
It has been reported that U.S. Citizenship and Immigration Services (USCIS) has indicated that employment-based numbers may be exhausted sooner than expected and could become unavailable or subject to new retrogression during the month of July. USCIS reportedly has sufficient numbers of immigrant cases in its adjudications pipeline to meet the reported 40,000 employment-based visa numbers that remain for Fiscal Year (FY) 2007. If employment-based numbers become unavailable in mid-month, USCIS could cease accepting applications for adjustment of status before the end of the July, though it is not yet possible to predict when this could occur.
It has been reported and unofficially confirmed by FRAGOMEN that U.S. Citizenship and Immigration Services (USCIS) has indicated that employment-based immigrant visa numbers may be exhausted sooner than expected and could become unavailable or subject to new retrogression during the course of the month of July. This would be contrary to information in the July Visa Bulletin issued by the Department of State, which stated projected availability through the month of July.
Agency representatives have reportedly stated that USCIS has sufficient numbers of employment-based immigrant cases that are ready to be approved and counted against the estimated 40,000 employment-based numbers that remain for Fiscal Year (FY) 2007. USCIS has not officially confirmed these reports. Our understanding is that discussions on the issue of visa availability have been escalated to a high level in the government and we will continue to seek definitive information.
There has been speculation that a change in anticipated demand may be the result of inaccurate projections by the government about the number of employment-based cases that are both ready for approval and have completed security checks.
If employment-based numbers become unavailable, it is likely that USCIS would stop accepting applications for adjustment of status, regardless of the information contained in the July Visa Bulletin. It is also possible that the State Department could release a Supplemental Visa Bulletin that updates its forecasts of visa availability. Though it is possible that USCIS would continue to accept adjustment applications through July despite visa unavailability, this appears to be unlikely.
As previously mentioned, it is our understanding that discussions are underway both within USCIS and between USCIS and the Department of State, and FRAGOMEN continue to seek more definitive information. We will issue additional Client Alerts as new information becomes available. If you have any questions about this Client Alert, please contact your designated FRAGOMEN professional.

Filed for renewal on 04/05 and still waiting for receipts. Current EAD expires last week of July and am running the risk of losing my job if I don't get it by then.
Does anyone know what are my chances of getting it before then? Also, what are my other options at this point or before I lose my job. I read about interim EAD's on other posts, is this still an option?
Your response is highly appreciated.
Sincerely.

They are definitely approving beyond June 8th but there are many people with RD's from May 07 and before and much older priority dates still waiting. Do not read too much into the approvals you see the approvals are somewhat random to say the least.
EB3 ROW, PD November 2002, RD May 2007. Still not approved. Getting impatient seeing people getting approvals with later priority dates and receipt dates. Think my application has got lost in a corner somewhere.
I know, but I cannot help being hopefull, especially since some lucky guys here have finally gotten it. I am glad for them and hope that soon you and me will follow them!
I will send a little extra luck with this for you :)

These phony DCC's(not all of them) are a major culprit in screwing up the H1B as well as the Perm process.

Hello,
My PD has become current as of june visa bulletin and I am eligible to apply for I-484. But currently I am expecting and hence I may not be able to take all the medical exams (X-Rays etc..). Can I still apply for 485 and complete the medical exam later or do they need the complete medical report when I apply for I-485. I would appreciate if anybody can share any info in this regard. Thanks.

Hello Susie,
My daughter accompanied me on H4 visa. My labor was approved in June 2006 and she turned 21 in July 2006. My I 140 was approved in Dec 2006. I have received valuable inputs from IV members and understand that she has aged out. I believe that things can be simplified if unmarried children under 21 who come as dependants of workers with dual intent visas or similar catagories are exempt from ageing out rules. This may avoid lengthy rules, computations, complex interpretations and possibly lawsuits.
I would be most interested to see the evidence supporting your statement and the information you have received from IV members. Since in one breath you are saying your daughter has aged out and in the next you are suggesting she is exempt from aging out rules???

My apologies for replying to a posting from like a million years ago :-)
But, I really do not understand why you have to knock Saralayar like that in your reply. What has he said that is so offensive or disgusting?
I really see no problem with his/her post, he was just asking the IV community if his issue can be addressed or not. Its up to the community as a whole to decide what to do with it.
Relax, the sky is not falling down on you!
I am surprised, but are you really a member of the "high skilled" community or are you just faking it to be on this forum?
I don't think you should embarrass your self or your profession, though we do not know your identity.

I am having hard time procuring a Non-availability of Birth record certificate(NAC) from my home city of Delhi. Is there a way around this? I do have affidavits from my parents.
This NAC is holding up my application. Can we submit the document that you get in 10th grade with date of birth instead of the NAC. The NAC process takes a month or so, Police check...local magistrate orders the local municipal corporation et al.
Any suggestion will be greatly appreciates. Sorry if this post is in the wrong thread.
